These Terms of Use govern your use of digitalelectronics.com.au and any purchase of goods or services from Digital Electronics, operated by Paul Bourke. By using this website or placing an order, you agree to be bound by these terms.

Use of This Website

You may use this website for lawful purposes only. All content on this site, including text, images, logos and product descriptions, is owned by or licensed to Digital Electronics and may not be copied, reproduced or used without our permission.

Terms and Conditions of Sale

    1. Payment for online orders is required in full at the time of purchase via our secure checkout. Where goods or services are supplied on account or by invoice (for example, trade or repair work), payment is due within 7 working days of the invoice date unless otherwise agreed in writing. Overdue accounts incur a 10% late payment fee on the outstanding invoice amount.
    2. Digital Electronics retains ownership (title) of goods until payment is received in full. Until full payment is received, Digital Electronics reserves the right to: (a) enter the customer’s premises to repossess unpaid goods, without liability for trespass or resulting damage; (b) resell any goods repossessed under (a); and (c) recover from the customer any shortfall arising from such a resale due to a change in the condition of the goods while in the customer’s possession.
    3. The customer agrees to reimburse Digital Electronics for all reasonable costs, charges, fees and expenses incurred in recovering outstanding monies, including debt collection agency and legal fees.
    4. To the maximum extent permitted by law, Digital Electronics is not liable for injury, damage or loss (whether direct, indirect or consequential) arising from the use of goods purchased from us. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
    5. Digital Electronics is not responsible for the loss of software, data or other electronic information resulting from a repair or service. It is the customer’s responsibility to back up any software, data or information they consider important before handing over a device for service or repair.
    6. Goods purchased are also subject to: (a) any licensing agreements attached to the goods that govern their use; and (b) any applicable manufacturer’s warranty, in addition to the Digital Electronics warranty set out below.
    7. Where goods or services are supplied as part of an installation, any additional terms and conditions contained in the specific installation agreement will also apply.

    Order Cancellations and Restocking Fees

    Orders may be cancelled free of charge if a cancellation request is received before the order has been dispatched. Once an order has been dispatched, it cannot be cancelled and is instead subject to our standard Returns & Refunds policy. Where a payment processing fee has been incurred by Digital Electronics as a direct result of the transaction, this fee (non-refundable to us by our payment provider) may be deducted from the refund amount at our discretion.

    Change-of-mind returns are accepted within 30 days of delivery, provided the item is unused, in original packaging, and in resaleable condition. A restocking fee of 15% of the item’s purchase price applies to all change-of-mind returns to cover handling, testing, and re-listing costs. This fee does not apply to items returned due to fault, damage, or incorrect description, which remain covered under your Australian Consumer Law rights.

    A change-of-mind return applies where the customer no longer wants the item purchased. It does not entitle the customer to a free exchange or refund solely because a different variant (such as a different colour, size, capacity or model) is preferred after purchase. Requests to swap for a different variant are treated as a change-of-mind return of the original item (subject to the restocking fee above) followed by a new, separate purchase of the preferred variant.

    Some products are shipped directly from our suppliers and are not held as physical stock by Digital Electronics. For these items, a return processing fee (rather than a restocking fee) may apply to change-of-mind returns, reflecting the actual costs of return freight and supplier processing. We will advise the applicable fee at the time a return is requested.

    Nothing in this Cancellations and Restocking Fees section limits or overrides any right you have to dispute a transaction with your bank or card provider, or any right or remedy available to you under the Australian Consumer Law.

    Order Acceptance and Delivery

    Receipt of payment does not constitute acceptance of an order. Digital Electronics reserves the right to decline, cancel or refund an order at any time before dispatch, including where stock is unavailable from our suppliers, in which case a full refund will be provided.

    Delivery timeframes provided on this website or in order communications are estimates only and are not guaranteed. Digital Electronics is not liable for delays caused by suppliers, freight carriers, customs processing, or other circumstances outside our reasonable control.

    Limitation of Liability

    To the maximum extent permitted by law, and except for any liability that cannot lawfully be excluded or limited under the Australian Consumer Law, the total liability of Digital Electronics arising out of or in connection with any goods or services supplied is limited to the amount paid by the customer for those goods or services.

    Pricing and GST

    All prices displayed on this website are in Australian Dollars (AUD) and are inclusive of GST (Goods and Services Tax) where applicable.

    Warranty

    All products sold by Digital Electronics carry a standard 12-month (1 year) warranty from the date of purchase, covering manufacturing defects under normal use. This warranty is in addition to, and does not limit, any consumer guarantees you have under the Australian Consumer Law. The warranty does not cover damage caused by misuse, accident, unauthorised repair or modification, or normal wear and tear.     Refurbished products are covered by a 30-day return-to-base warranty from the date of delivery, rather than the standard 12-month warranty. Under this warranty, the customer is responsible for returning the faulty item to Digital Electronics at their own cost; once received and the fault is confirmed, Digital Electronics will repair, replace, or refund the item at its discretion. This warranty is in addition to, and does not limit, any consumer guarantees available under the Australian Consumer Law.

    Customs Duties and International Orders

    Some products sold by Digital Electronics are grey-import goods sourced directly from overseas suppliers and imported into Australia for resale. For orders with a customs value of AUD $1,000 or less, any applicable customs duty, GST and clearance charges on importation into Australia are the responsibility of Digital Electronics and are factored into the listed price. For orders with a customs value over AUD $1,000, the customer is responsible for any customs clearance fees, customs duty and GST applicable on importation, in accordance with Australian Border Force requirements.

    For orders shipped outside Australia, the customer is responsible for any customs duties, import taxes, tariffs or other charges imposed by the destination country. Digital Electronics is not responsible for, and does not cover or reimburse, any such charges.

    Pricing and Product Information

    All prices are listed in Australian Dollars (AUD) and may change without notice. While we make every effort to ensure product information and pricing are accurate, we reserve the right to correct any errors and to cancel or amend an order affected by a pricing or listing error, in which case we will contact you before proceeding.

    Intellectual Property

    The Digital Electronics name, logo and website content are the property of Digital Electronics / Paul Bourke and may not be used without prior written consent.

    Governing Law

    These Terms are governed by the laws of Western Australia, Australia, and you submit to the non-exclusive jurisdiction of its courts.

    Changes to These Terms

    We may update these Terms of Use from time to time. Continued use of the website or purchase of goods after changes are posted constitutes acceptance of the updated terms.
